These terms are the agreement between you and [CONTROLLER NAME — to be completed] for the use of Firstnamed. By creating an account you accept them. They are meant to be readable; if anything here is unclear, ask us before you sign up rather than after.

What the service does

Firstnamed asks AI assistants the questions you choose, repeatedly, and records how often your brand is named in the answers, who else is named, what the answers say about you, and which pages the assistant read. You get results in the app, an optional email, and a report you can download.

Answers are collected by sending your questions to third-party AI providers — ChatGPT, Gemini, Perplexity and Google's AI Overviews. We do not control what they answer, and their answers change over time for reasons that have nothing to do with you or with us.

What we do not promise

This is the part worth reading twice. Firstnamed is a measuring instrument, not a marketing service:

  • We do not promise your visibility will improve. We measure it. What you do with the measurement is yours, and whether an AI assistant names you is decided by the assistant.
  • We do not promise the numbers are stable. AI assistants give different answers to the same question, and change without notice. That variability is what we measure; it is not a fault.
  • We do not promise the assistant is right. Where the app reports what an answer said about you, it is reporting the answer, not endorsing it.
  • We do not promise a page is the cause of anything. Where the app shows the pages an assistant read, it is showing what was read alongside an answer, not why the answer said what it said.

Your account

  • One account, one brand. Keep your password to yourself; you are responsible for what is done through your account.
  • Tell us promptly if you think someone else has access to it.
  • You must be old enough to enter a contract, and you must have the authority to act for the brand you track.
  • Firstnamed is for business use: for a business, or for work you do under your own name as a sole trader, freelancer or professional (a personal account). It is not for use as a consumer.
  • You can delete your account yourself at any time, from the account page. Deletion erases your data immediately and cannot be undone.

Plans, allowances and payment

  • We review every new account by hand, including one that starts on a paid plan, and may decline one. Nothing runs until we approve it.
  • The free trial runs for 14 days and needs no payment details. It starts when we approve your account. When it ends, checks stop until you choose a plan. Nothing already measured is deleted at that point.
  • You can start on a paid plan instead. Choose Starter or Growth when you sign up, without giving payment details. Your plan starts when we approve your account, and so does payment. We charge nothing before that, and nothing at all if we decline the account.
  • Plans are monthly and paid in advance, priced as shown on the plans page, in pounds sterling. Prices there are what you pay. Each month runs from the day your plan started: the day we approved your account, or the day we moved it onto the plan after a free trial.
  • Each plan has limits — how many questions are tracked and how many can be swapped each month, how often checks run automatically, and how many checks you can start by hand each day and each month. They are shown in the app before you hit them, and they are there because every check costs us real money to run.
  • A check that fails and records nothing does not use up your allowance. It is given back automatically.
  • You can cancel at any time. You keep everything until the end of the month you have paid for, and we don't charge you again. We do not refund part-months, because the month's checks have already been bought and run.
  • If we change a price, we will tell you before it applies to you, and you can cancel instead.

What you may not do

  • Resell the service, or share one account across separate businesses.
  • Try to get around plan limits or rate limits — automating the app, running many accounts for one brand, or similar.
  • Track a brand you have no right to act for, or use the service to harass anyone.
  • Attempt to break, overload or probe the service or its suppliers. Responsible security reports are welcome and will never be treated as a breach of these terms.

If something here is broken, we would rather you told us than exploited it. If you do exploit it, we may suspend the account.

Your data, and your content

The questions, brand details and competitors you enter stay yours. You give us permission to use them only to run the service for you — to ask the questions, analyse the answers and show you the results. We do not sell your data, we do not share it with other customers, and we do not use it to train AI models.

The privacy notice explains what we hold, who processes it, how long we keep it and what you can ask us to do. It forms part of these terms.

If you add our tag to your website to count visits from AI assistants, telling your visitors about it in your own privacy notice is your responsibility, and so is getting their consent wherever the law you are under requires it. The tag may only be used on a website you run. We use what it sends only to produce your report, and for no purpose of our own.

The answers we collect come from third-party AI assistants and may themselves quote or summarise other people's material. We store them so you can see what was said; they are evidence of what an assistant answered, not content we publish.

Availability

We aim to keep the service running and to run your scheduled checks on time, but we do not offer a guaranteed uptime. Checks depend on third-party services, and when one of those is unavailable a check may be delayed or fail. A failed check gives back its allowance; it does not entitle you to a refund of the month.

We may change how the service works, including how answers are collected. Where a change alters what the numbers mean, we will say so in the app rather than let a change in method look like a change in your market.

Ending it

  • You can leave at any time, by cancelling your plan or deleting your account.
  • We can suspend or end an account that breaks these terms, or where we are required to. Except in serious cases we will tell you first and give you a chance to put it right.
  • After a trial ends, or a cancelled plan reaches the end of its paid month, we keep your data for 30 days so you can come back to it, warn you by email before the end, and then erase it. Deleting your account erases it immediately instead.
  • We may stop offering the service. If we do, we will give you reasonable notice, stop charging you, and leave you time to export your data.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, and because this is a business-to-business service: we are not liable for lost profits, lost business, lost goodwill or for decisions you take based on the measurements, and our total liability to you in any twelve-month period is limited to what you paid us in that period. On the free trial, where you have paid nothing, that limit is nil.

You are responsible for what you do with the results, including anything you publish that relies on them.

Changes to these terms

We may update these terms. If a change materially affects you we will tell you by email before it takes effect, and continuing to use the service after that date means you accept it. If you do not, cancel before it applies.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute. If part of these terms turns out to be unenforceable, the rest continues to apply.
